Internal Affairs Guidance

Below you will find general guidelines for the Internal Affairs investigation process while we are operating exclusively under TLGC Ch. 143. This guidance is subject to change as we navigate ongoing changes to the process by City Management, Executive Staff, Internal Affairs, and the OPO.  

 

***As a reminder, witness officers are not allowed representation during interviews.  If you are a witness officer and have questions about the process, please reach out to the APA. 

 

Nothing in this educational document shall be construed as the APA’s implied acceptance or agreement that actions taken by the city, to include the OPO, are lawful and in compliance with Texas law.  

 

Process as of February 13, 2024: 

 

  • Subject Officer will prepare for IA interview with attorney and APA rep at the Internal Affairs office on the date and time of the interview, unless otherwise planned.  Prior to your interview date, please scan and email a copy of your NOA to your attorney and APA Rep. 

  • Subject officers will be given access to BWC, DMAV, and reports/supplements in which they are the author to review with their attorney and APA rep during the preparation period.  Based on the circumstances, IA may provide additional video or materials for review. 

  • The officer may take notes during the preparation period. Keep in mind IA may collect and review your notes. Do not write any notes or bring outside materials that could adversely impact the outcome of the investigation. 

  • You may have your attorney or representative present for the entire interview.  The APA advises you to have your attorney remain in the room. 

  • Your attorney may provide you with a statement to read at the beginning of the interview to establish on the record that you have not given permission to the OPO to be present or have access to the investigative file. The APA advises you to read any statements provided to you by your attorney. 

  • Upon conclusion of the interview, the IA Sgt will inform you that the interview is being sent to transcription and you will be asked to return to the office to review the transcript. Your APA rep and attorney will discuss this process with you in more detail to ensure you are prepared for the review. REQUEST A COPY OF YOUR TRANSCRIPT AND PROVIDE TO APA REP AND ATTORNEY ASAP.
